All delivered products remain the property of XXL RACING sim racing expert® until full payment, including any shipping and additional costs, has been received. Until that time, the customer may not sell, pledge, or otherwise encumber the goods.

10. Force majeure

We are not liable for any failure to fulfill our obligations if this is caused by force majeure, including but not limited to internet or telecommunication failures, natural disasters, war, strikes, fire, pandemics, transport problems, or government measures. In such cases, we have the right to suspend our obligations or dissolve the agreement without liability for damages.

11. Fraud and chargebacks

We reserve the right to cancel or refuse orders in case of suspected fraud or misuse of payment methods. Unjustified chargebacks will be legally contested and may result in collection costs and damages. Fraudulent behavior will be reported to the relevant authorities and payment providers.

12. Complaints and disputes

We strive for customer satisfaction. Complaints can be submitted via info@xxlracing.nl. We respond within 14 days of receipt. If this does not lead to a solution, the dispute may be submitted to the competent court or, where applicable, to a recognized dispute resolution body (Alternative Dispute Resolution, ADR).

13. Governing law and jurisdiction

These terms and all agreements between you and XXL RACING sim racing expert® are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the district where XXL RACING is established, unless mandatory law provides otherwise.
